These terms and conditions apply to Services (the "Service") provided by DolfinED ("DolfinED", “DolfinED team”, or "we" or "us") through the Website http://www.dolfined.com/ ("the Website"). "You", “The Client”, “The Customer”, or "Your" refers to you as the Learner or user of the Website.
- IF FOR ANY REASON YOU DO NOT WANT TO ACCEPT THESE TERMS, YOU MAY NOT ACCESS OR USE DOLFINED's WEBSITE OR ANY RELATED SERVICES.
- THESE TERMS AND CONDITIONS REQUIRE THAT ANY DISPUTE BETWEEN YOU AND DOLFINED BE RESOLVED AS AN INDIVIDUAL CASE, NOT BY ANY CLASS OR REPRESENTATIVE ACTION.
Upon accepting these Terms, You give DolfinED the permission to call or contact You via Emails or any other means to share with you products, services, upcoming events, webinars, or promotions. Furthermore, your acceptance of these Terms provides DolfinED the right to feature Your picture in any photos, videos, or other promotional material produced by DolfinED.
However, we shall not distribute or share your personal information with any third-party marketing database. Moreover, we shall not disclose your personal information to any third party except on a case-to-case basis after proper verification of such third party or if required under any applicable law.
You accept and agree to be bound by this Agreement's terms by subscribing, viewing, or using any of the Services. You must agree to this Agreement's terms before you will be allowed to use any of the Services.
Job and Earnings Disclaimer
It should be understood that potential jobs, earnings, and income statements made by any DolfinED employee or instructor in any Services are based on Internet resources and analysts. These are averages and/or estimates only. Therefore, there are no potential income guarantees for you. Consequently, you accept the fact that earnings and income statements differ from one individual to another and are primarily based on available jobs in your region, how you do in your interviews, and many other factors.
Furthermore, there are no guarantees concerning the level of success you may experience. Each individual's success depends on their background, dedication, experience, interview skills, invested effort, and motivation.
Moreover, You recognize and agree that the DolfinED Team made no implications, warranties, promises, suggestions, projections, representations, or guarantees whatsoever to you about prospects, jobs, or earnings, or that you will earn any money with respect to your purchase of any DolfinED products and that we have not authorized any such projection, promise, or representation by others.
Restrictions on Transfer, Use, and Alteration
Also, you may not decompile, disassemble, or otherwise attempt to derive the source code, slides, text, or any content of the Services.
Moreover, you may not modify, copy, reproduce, re-publish, sub-license, sell, upload, broadcast, post, transmit or distribute any of the Services or create any derivative work of them or the accompanying documentation. Derivative works include, but are not limited to, translations. You may not alter any files that may be downloaded as a result of accessing the Services, including but not limited to e-Books, Lab Guides, Study Planner, Progress Tracker, Instructors handouts, e-Notebooks. This Agreement does not permit the sharing or use of DolfinED's materials in a physical or virtual classroom setting or otherwise. Furthermore, you are not authorized to record on digital devices, audio, or video any DolfinED’s live or streaming events under the Bootcamps or any live Instructor-led Services.
Also, you are not authorized to remove any copyright or other notice of DolfinED on any of the Services materials, including on-demand video courses, live instructor-led courses, and e-Books, or similar.
Disclaimer of Warranties and Limitation of Liability
DolfinED Website and the Services are provided on an “AS IS” and “As Available” basis without any warranties of any kind.
Unless otherwise explicitly agreed to in writing by DolfinED, We make no other warranties, express or implied, in fact, or law, including, but not limited to, any implied warranties of merchantability or fitness for a purpose other than as outlined in this Agreement.
DolfinED makes no warranty that the Services will meet your requirements or operate under your specific conditions of use. Furthermore, DolfinED makes no warranty that the Services' operation will be secure, error-free, or free from interruption. You must determine whether the Services sufficiently meet your requirements for security and un-interruptability. You bear sole responsibility and all liability for any loss incurred due to the Services' failure to meet your requirements. DolfinED will not, under any circumstances, be responsible or liable for the loss of data on any Computer or Information Storage Device.
Under no circumstances shall DolfinED, its Directors, Officers, Instructors, Employees, Contractors, Investors, Shareholders, or Agents (the "DolfinED Team") be liable to you or any other party for indirect, consequential, special, incidental, punitive, or exemplary damages of any kind (including lost revenues or profits or loss of business) resulting from this Agreement, or the furnishing, performance, or use of the Services, whether due to a breach of contract, breach of warranty, or the negligence of DolfinED or any other party, even if DolfinED is advised beforehand of the possibility of such damages. To the extent that the applicable jurisdiction limits DolfinED's ability to disclaim any implied warranties, this disclaimer shall be effective to the maximum extent permitted.
Also, You acknowledge that DolfinED is not liable for any illegal, offensive, or actual or alleged defamatory actions of other users of the Website or any other third parties.
Limitation of Remedies and Damages
The remedy to you for a breach of this Agreement is the correction of the Services. Selection of whether to correct or replace the Services will be at the sole discretion of DolfinED. If DolfinED is unable to provide a correction, replacement, or substitute Services, your sole alternate remedy shall be the termination of the respective or concurrent purchase or subscription. This does not apply to any of the free Services.
Limitation of Liability for Paid Services
In connection with any purchase, be it for a purchase or a subscription/membership to any of the Services; The maximum liability of DolfinED is limited to the amount paid to DolfinED for that specific Service giving rise to such a claim during the then-current membership period limited to a maximum of the twelve (12) months immediately preceding the claim.
Availability of Website and Services
While we make our effort to ensure the uptime of the Website and Services, DolfinED will not be liable if, for any reason, the Website and/or Services are unavailable for any period or any time. Access to the Website or Services can be temporarily suspended in the event of maintenance, repair or failures, or any other reasons outside of DolfinED's control.
If any provision of this Agreement shall be held to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect. To the extent any express or implied restrictions are not permitted by applicable laws, these express or implied restrictions shall remain in force and effect to the maximum extent permitted by such applicable laws.
Member Account Security
If any services require you to sign up or open an account. In that case, you must complete the registration process by providing DolfinED with current, complete, and accurate information prompted by the applicable registration form. You must choose a password and a username. You are solely responsible for maintaining the confidentiality of your password and account credentials. Furthermore, you are solely responsible for any and all actions or activities that occur under your account, excluding any breaches of your account that occur within DolfinED.
By initiating a DolfinED member account, you agree to notify us immediately of any unauthorized use of your account or any other security breach. DolfinED will not be liable for any loss that you incur due to the use of your password or account by any third party, either with or without your consent. However, you may be held liable for losses incurred by DolfinED that result from third-party access to your account or password. You may not use anyone else's account at any time as all member accounts are intended for use by the single intended registrant.
You agree to defend, indemnify, and hold harmless The DolfinED Team from and against any and all loss, damages, liability, costs, and expenses (including attorneys' fees) arising from third-party claims related to your use of the Website or the Services. DolfinED will have the right to take over the exclusive defense of any claim for which we are entitled to indemnification; in that case, you will reasonably cooperate with DolfinED's requests related to the indemnification.
Revisions and Errata
The materials appearing on the Website may include technical, typographical, or photographic errors. DolfinED does not warrant that the materials on its Website are accurate, complete, or current all the time. DolfinED may make changes to the materials contained on its Website at any time without prior notice.
Upon completion of any Instructor-Led training with DolfinED, a certificate of completion will be provided to You. This is not a vendor certificate. To achieve a vendor certification, you are required to pass the vendor's certification exam.
Cloud Provider Costs Disclaimer
Many hands-on practice labs are included in DolfinED’s published self-paced content and Live boot camps. You will need to create resources on 3rd party platforms (AWS, Microsoft Azure, Google Cloud, GitHub, and other platforms) to do these labs. It needs to be clearly understood that any costs incurred to set up and use these resources are NOT included in the purchase prices paid to buy or enroll in DolfinED’s services and products; instead, these costs must be paid by you.
It also needs to be clearly understood that it is your responsibility to delete these resources that you no longer need or use.
If you decide to sign up for an existing free trial. In that case, your trial will automatically get converted into a paid membership/subscription at the end of the trial period unless you cancel the trial before the trial period expires. Once your free trial gets converted into a paid subscription/membership, you will be charged the recurring subscription fees described at the free trial checkout. To avoid any such charges, please make sure that you change your account settings to cancel the free trial before it ends.
DolfinED's Payment, Pricing, & Refund Terms
For all DolfinED's Services, unless otherwise specified at the time you purchase the Services or the Subscription, the fees are exclusive of VAT or other local taxes.
All fees shall be exclusive of any amounts payable to any vendor, professional body for registration and examination entry. Such certification exam fees are payable by you directly to the relevant vendor, professional body, or examination board. We accept no responsibility or liability for your failure to book your exam with the appropriate professional body or examination.
Fees for the Service selected by you on the Website shall be debited from your credit/debit card at the time of purchase or right after the free trial expiry if applicable. Fees must be paid in full (or the monthly subscription in case of monthly memberships) prior to you accessing the Services.
Any fees charged by your debit or credit card provider in connection with your purchase of Services are for your account, and DolfinED shall not be responsible for these.
DolfinED uses a 3rd party as the credit card payment gateway.
In consideration of the fees paid by you, we grant to you a limited, non-transferable, non-exclusive license to use the Services for the sole purpose of completing the Self-Paced Services and/or attending the Instructor-Led Services where applicable.
Payment and Refunds for DolfinED Services (On-demand Video Courses, Assessments, E-Books):
We provide a refund time window of seven (7) days for any paid Services that does not have a free trial. We assess the Refund request and verify that You did not abuse the 7 days refund policy by finishing desired courses or a great extent thereof before asking for the refund. In case abuse was determined, we will not honor the refund request.
For services with a free trial period; once the free trial expires, it will be converted into a subscription-based service and governed by the terms outlined below.
All DolfinED Services one-time or subscription fees must be paid via credit card only. DolfinED supports all major credit cards. Acceptance of any alternate forms of payment for any DolfinED Service is at the sole discretion of DolfinED. Discounts and other promotional offers may only be valid for the initial term. Special terms may apply to discounted or promotional DolfinED Services. See the specific offer for further details.
DolfinED may increase subscription fees for a subsequent subscription period at any time and for any reason, provided that DolfinED provides notice at least thirty (30) calendar days prior to the subscription's expiration. DolfinED may terminate the subscription if unable to renew the subscription due to any issue with credit card processing, including but not limited to inaccurate or outdated credit card information.
For Services or subscriptions with a free trial period; once the free trial expires, all DolfinED's Services subscription fees are final and non-refundable. The DolfinED subscription Service will renew at the end of each term automatically. Subscription renewal fees for one-year (yearly) plans are eligible for a refund up to seven (7) days after the subscription renews, providing your account has not been in use since the renewal date. Refund requests must be received via email to firstname.lastname@example.org. Subscription renewal fees for one-month (monthly) subscriptions are non-refundable under any circumstances. Consideration beyond the stated terms for refunding all or part of your DolfinED Services' Subscription renewal fee is at the sole discretion of DolfinED.
Payment and Refunds Instructor-Led Programs and Services (Bootcamps, Live-Classes, Live Webinars):
The fees for these Services shall be set out on the Website when you placed an order for them. The only way to guarantee a seat for such a Service is to pay the fees separately (if applicable) or for a bundle subscription where the respective Service is bundled.
You shall be responsible for all costs you incur in connection with your attendance for any in-class Services, and this includes Travel and Lodging.
Refunds for instructor-led Services are subject to the following terms:
- For instructor-led sessions or bootcamps purchased separately (not in a bundle), a full refund is furnished if the refund request is received in writing thirty (30) calendar days before the Service’s scheduled start date.
- Instructor-led Services that were purchased bundled with any other self-paced Services or/and any promotional items will be eligible for a full refund, minus the value of self-paced materials and any promotional items that were included with your order.
- No refund will be furnished in case of a no-show. However, as applicable, You can access the recordings of the sessions missed.
- In the event that the purchaser and attendee are not the same person, refunds will be processed to the purchaser.
- Any refund request received within the Thirty (30) calendar days of the scheduled Service start date will incur additional cancellation fees. Cancellation fees will be based on a percentage of the price you paid for the Instructor-Led Service.
- Requests for refunds on Instructor-Led Services with a specific class date are subject to a cancellation penalty as follows:
- Canceling 39-21 days prior to the Service start date chosen on your order will incur a 10% cancellation fee.
- Canceling 20-11 days prior to the Service start date chosen on your order will incur a 20% cancellation fee.
- Canceling 10-7 days prior to the Service start date chosen on your order will incur a 30% cancellation fee.
- Canceling six or fewer days prior to the Service start date chosen refunds will not be permitted.
- DolfinED team strives to make available the best learning content. If you enroll in any instructor-led bundles or programs and you did not achieve the desired results, you can ask for a refund within sixty (60) days from the original purchase date. This is provided that you can provide proof that you took action, attended the live sessions, and did all assignments and practice activities, or you show the proof that you attended the exam (if applicable) and failed.
- This refund will minus the value of self-paced content and any promotional items included with your order.
DolfinED reserves the right to cancel or reschedule any Instructor-Led Service. DolfinED shall not be liable for lost travel expenses or any other expense incurred by You related to a rescheduled Service. DolfinED assumes no liability in the case of war (declared or undeclared), natural or human-made disasters, delays or inability to travel, or other forces outside of DolfinED's control through which DolfinED determines attending an Instructor-Led Service may cause risk to students or DolfinED’s employees.
An Instructor-Led confirmation will be provided fourteen (14) days before the start date. In the unlikely event that DolfinED must cancel an Instructor-Led Service within 14 days of the scheduled start date, you will be notified immediately, and we will work with you to determine the appropriate solution.
DolfinED may provide bundles or Services for Lifetime Access memberships. You agree that this "Lifetime Access" means, as long as DolfinED exists and the content included in the respective Bundle is current and not obsolete, expired, or canceled by the respective vendor, DolfinED will keep that content available, and you will have access to it. In the event that some or all the content becomes obsolete or expired or no longer supported by the vendor, DolfinED will have the right to remove that content or replace it with the then-current version of that content.
DolfinED guarantees you access to that content for at least five years as part of your Lifetime Access membership. This lifetime access is not transferrable to your beneficiaries in the event you are deceased.
DolfinED has the right to immediately terminate your access to the Website if you engage in any conduct which we, in our sole discretion, determine to be unacceptable or if you breach any of these Terms.
Moreover, DolfinED shall be entitled to terminate these terms and conditions and cease to provide you with any Services with immediate effect in the event that you:
- Fail to pay your fees when due.
- Act in an aggressive, offensive, threatening, harassing, or bullying manner towards any of the DolfinED Team members, its Students, Leaners, Suppliers, or Instructors.
- Cheat or Plagiarize in any work you are supposed to submit to DolfinED in connection with the Services provided.
Any Services provided by DolfinED or the DolfinED Team under these terms and conditions are personal to you and cannot be transferred or assigned to any other person. We shall be entitled to assign these terms and conditions to any other company without prior notice to you.
Moreover, DolfinED may assign, transfer, sub-contract any of our rights or obligations to any third party at our discretion and without prior notice.
DolfinED shall not be liable to you for any breach of its obligations or termination under these terms and conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course driven by a death in the trainer's family, illness of the trainer, Government mandate or regulation.
DolfinED runs an affiliate program to increase sales. DolfinED members willing to become DolfinED affiliates have to submit a request via email indicating their willingness. DolfinED has the right to approve or reject any such a request at its own discretion. If an Affiliate is approved and enabled, DolfinED reserves the right to cancel this affiliate status for any affiliate at its discretion. If DolfinED decides to disable or cancel an affiliate relation, all pending payments will be cleared in due course. The affiliate will be notified beforehand of DolfinED’s decision. You hereby agree to these affiliate terms as an integral part of your agreement to the overall Terms in this document.
Most disputes can be resolved, so before bringing a formal legal case, please first try contacting DolfinED’s support team at email@example.com. DolfinED’s support team will be available and happy to help in resolving the dispute.
You also agree not to bring the claim into another court or participate in non-individual class actions against DolfinED Team.
Law and Jurisdiction:
This Agreement and any related dispute are subject to DolfinED’s home jurisdiction laws without regard to its conflict of law provisions.
No Class Actions
DolfinED and You both agree that we can each only bring claims against the other on an individual basis. This means DolfinED, and You agree not to bring any claim as a plaintiff or class member in a class action, consolidated action, or representative action. Moreover, this also means DolfinED, and You agree that an arbitrator can’t combine multiple people’s claims into a single case (or preside over any consolidated, class, or representative action). Furthermore, an arbitrator’s decision or award in one person’s case can only impact that person, not others, and can’t be used to decide other persons’ disputes. If a court decides that this “No class actions” clause isn’t enforceable or valid, then this “Dispute Resolution” section will be null and void, but the rest of the Terms will still apply.
